CNN —A New Mexico grand jury will soon decide whether Alec Baldwin should once again face criminal charges over the 2021 death of “Rust” cinematographer Halyna Hutchins. “We will answer any charges in court.”Hutchins was killed and director Joel Souza injured when a gun held by Baldwin fired a live round during a scene rehearsal. Fred Hayes/Getty ImagesBaldwin denied pulling the trigger on the weapon in a previous interview with CNN. The film’s assistant director, David Halls, was identified as the person who handed the firearm to Baldwin that fateful day. Earlier this year, he signed a plea agreement “for the charge of negligent use of a deadly weapon,” prosecutors said, noting that terms of the deal include six months of probation.

CNN —Prosecutors in the “Rust” fatal shooting case plan to file a notice to dismiss involuntary manslaughter charges against Alec Baldwin, his attorney, Luke Nikas, tells CNN. CNN has contacted the special prosecutor in the Santa Fe, New Mexico case for comment. Baldwin and “Rust” armorer Hannah Gutierrez Reed were both charged with involuntary manslaughter in January. An attorney for Gutierrez Reed has previously said she will plead not guilty. Prosecutors already removed a firearm enhancement charge against Baldwin and Gutierrez Reed, reducing a potential prison sentence from 5 years to a maximum of 18 months.

Baldwin named all four as cross-defendants in a lawsuit originally filed against him last year by Mamie Mitchell, the film’s script supervisor. Baldwin said he relied on all four to do their jobs, and that Hutchins died as a result of their negligence. As a result, Baldwin says he has experienced “immense grief” and suffered an “emotional, physical and financial toll.”“More than anyone else on that set, Baldwin has been wrongfully viewed as the perpetrator of this tragedy,” wrote Baldwin’s attorney, Luke Nikas. Further, Baldwin accuses Seth Kenney, the supplier, of showing a “cavalier disregard for proper separation between live and dummy ammunition.”All four have previously denied culpability. In a statement Thursday, Gloria Allred, who represents Mitchell, said Baldwin should take responsibility for his actions.
